Terms of Service

1. Acceptance of Terms

By accessing or using kafinder.be(“kafinder”, “the Service”, “we”, “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service. These Terms constitute a legally binding agreement between you and the operator of kafinder.be.

2. Description of Service

kafinder is a free community platform that helps students in Leuven, Belgium discover cafés and study spots. The Service provides:

• A directory of cafés with amenity information (WiFi, power outlets, noise level, etc.)
• Real-time crowd-sourced occupancy reports
• User reviews and ratings
• The ability to save favourite cafés
• The ability to suggest new places for inclusion
• Interactive maps

The Service is provided free of charge to students and will remain free for end users.

3. Eligibility

You must be at least 13 years of age to use kafinder. By using the Service, you represent that you meet this requirement. If you are under 13, you may not create an account or submit any user-generated content.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate and truthful information when registering.
• You may not create multiple accounts or share your account with others.
• You must notify us immediately at jrzeczkowski@proton.me if you suspect unauthorised access to your account.
• We reserve the right to suspend or permanently ban accounts that violate these Terms.

5. User-Generated Content

You may submit reviews, occupancy reports, suggestions, error reports, and other content (“User Content”). By submitting User Content, you:

• Represent that you own or have the right to submit the content.
• Grant kafinder a non-exclusive, royalty-free, worldwide licence to display, distribute, and use your User Content solely for the purpose of operating and improving the Service.
• Agree that your content is accurate and not misleading.
• Agree not to submit content that is defamatory, offensive, discriminatory, illegal, or spam.

We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, without prior notice.

6. Prohibited Conduct

You agree not to:

• Submit false, misleading, or fraudulent reviews or occupancy reports.
• Use automated tools, bots, or scrapers to access the Service.
• Attempt to reverse-engineer, hack, or disrupt the Service or its infrastructure.
• Impersonate another person or entity.
• Use the Service to advertise, solicit, or spam other users.
• Violate any applicable law or regulation, including the GDPR.
• Attempt to access another user's account or personal data.

7. Accuracy of Café Information

Café data (opening hours, amenities, etc.) is collected from public sources and user contributions. While we aim for accuracy, we cannot guarantee that all information is complete, current, or correct. Always verify opening hours with the café directly before visiting. We are not liable for any inconvenience caused by inaccurate information.

8. Service Availability

kafinder is provided “as-is” and “as-available” without any warranty of uptime or continuous availability. We may suspend, modify, or discontinue the Service at any time without prior notice. We will make reasonable efforts to notify users of planned maintenance.

9. Disclaimer of Warranties

To the maximum extent permitted by Belgian law, kafinder is provided without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free or uninterrupted.

10. Limitation of Liability

To the maximum extent permitted by applicable law, kafinder and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service, including loss of data, loss of revenue, or interruption of service, even if advised of the possibility of such damages.

11. Termination

You may delete your account at any time via your profile page. We may terminate or suspend your account immediately if you breach these Terms, without prior notice or liability. Upon termination, your right to use the Service ceases immediately.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Leuven, Belgium.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via a site-wide banner at least 7 days before taking effect. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. The “Last updated” date at the top of this page reflects the most recent revision.
